Consideration of this motion to dismiss for failure to state a claim and for lack of standing calls for a rational appreciation of the ultimate limits and workings of the three major branches of government.
This action is brought by plaintiff RAM, an unincorporated association all of whose members are recipients of public assistance, and by 14 individual welfare recipients, to challenge on a constitutional basis the adequacy of the welfare payment levels provided by section 131-a of the Social Services Law.
