BUSSEY, Presiding Judge:

George Walter Stevenson, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Garvin County, Oklahoma for the offense of Murder; his punishment was fixed at death, and from said judgment and sentence, a timely appeal has been perfected to this Court.

At the trial, Robert Washington testified that on the evening of January 4, 1971, he was at Mildred Hennessey’s cafe in Wynnewood, Oklahoma. At approximately 9:00 o’clock p. m., he observed the defendant and Bill Turner talking for a short time; he testified that he did not hear…
