Plaintiff, General Automation, Inc. (GAI), appeals from the November 23, 1999, order denying its motion to reconsider. On April 30, 1997, GAI filed a two-count complaint against defendant, American National Bank (ANB). Count I sought damages for common law breach of contract, and count II sought damages for violation of section 9 of the Illinois Fiduciary Obligations Act (the Act) (760 ILCS 65/9 (West 1996)).
