MEMORANDUM OPINION AND ORDER
DE MENT, District Judge.
This matter is now before the court on Defendants’ 1 motion for summary judgment filed on December 10,1996. The Defendants filed a brief in support of this motion on the same day. Plaintiff filed a response brief in opposition to the Defendants’ motion for summary judgment on December 24, 1996. Defendants filed a reply brief on January 14, 1997.
