MEMORANDUM AND ORDER
MORAN, Senior District Judge.
The City of Chicago Heights has fallen upon hard times. The Comprehensive Plan adopted in 1995 by the City describes the decline of the once vibrant commercial activity in the community and the flight of business to outlying malls. “The majority of existing retail and commercial service uses are found along Lincoln Highway/Route 30” (Comprehensive Plan at 12).
