— Will Grace was indicted for an assault upon Beverly Taylor, with intent to. commit murder in the first degree with a gun, and was convicted of an assault with intent to commit murder in the third degree.

On writ of error it was argued that the verdict is contrary to law, to the evidence and to the charge of the court, and that the court erred in, refusing a requested charge.
