Manuel Silver, á non-resident and a citizen of the Republic of Portugal, was arraigned in the city court of Brunswick under an accusation charging him with a misdemeanor, in that “he did take or catch oysters, fish, shrimp, prawn, turtle, terrapin, and other crustaceans from the salt waters of said State of Georgia, for the purpose of selling the same.” Before entering his plea of not guilty the defendant filed a demurrer to the accusation, on various grounds; which demurrer was overruled, and the defendant excepted pendente .lite.
