Plaintiff Federal Deposit Insurance Corporation (the “FDIC”), as Receiver for Colonial Bank (“Colonial”), brings this action against Boris Masarsky and Linda M. Surges (collectively, “Defendants”) asserting breach of contract, negligent misrepresentation, and negligence.
