Ngan Gung Restaurant, Inc., d/b/a the Silver Palace Restaurant (“debtor”), commenced this adversary proceeding for a declaratory judgment that an action brought pursuant to New York State Executive Law § 63(12) entitled People of the State of New York by Dennis C. Vacco, Attorney General of the State of New York v.
