OPINION

JACKSON, Judge:

¶ 1 Ogden City (the City) appeals the Ogden Civil Service Commission’s (the Commission) order reversing the City’s decision to terminate Daniel Harmon’s employment. We reverse and remand the Commission’s order.

BACKGROUND

¶ 2 This case involves the conduct of Daniel Harmon, a captain in the Ogden City Fire Department (the Fire Department). On September 8, 2000, the Fire Department received a complaint regarding an alleged incident of sexual harassment occurring two years prior, involving Harmon and a subordinate female employee.
