This is an appeal from an order of the Circuit Court of McHenry County dismissing Count II of plaintiff’s complaint as to all defendants. In effect, Count II of the complaint sought to enforce an alleged contractor’s mechanics lien on certain property. This count was dismissed on defendant’s motion for failure of the complaint to state a cause of action. Pursuant to Section 50 (2) of the Civil Practice Act (HI. Rev. Stat. 1959, Chapter 110, par. 50 (2)), the court ordered that no just reason existed to delay appeal of the cause, pending an adjudication of all of the issues, and so we may…
