This is an action to foreclose a mechanic’s lien under the provision of article 1, ch. 52, Comp. St. 1929.

Plaintiff’s petition alleges that on or about April 15, 1941, defendant Fred J. Dohse employed A. S. McGimsey, a contractor, for the purpose of constructing a dwelling and garage on defendants’ premises; that between April 15, 1941, and June 14, 194.1, both inclusive, the plaintiff sold certain materials to McGimsey and delivered the same on the defendants’ premises for the purpose ábove stated; that McGimsey promised and agreed to pay plaintiff the fair and reasonable value of the…
