Charged with the murder of John Paul Gonzales defendant was, after a court trial, found guilty of second degree murder. After a referral under section 1203.03 of the Penal Code he was sentenced to state prison.

Facts

The charge arose out of a post-midnight confrontation in the parking lot of the Coral Room on Beverly Boulevard in East Los Angeles. There is no question that Gonzales met his death as a result of a shot from a gun in defendant’s hand.
