This case involves the termination of appellant’s parental rights in his three year old son and the constitutionality of Ark. Stat. Ann. § 56-128 (Supp. 1983).
When the child, Jonathan, was less than a month old, a dispute over his custody arose. Subsequently, the child was determined to be dependent neglected and was placed in the foster care program. After several hearings in Miller County Juvenile Court, the appellee, Arkansas Social Services, filed a petition to terminate the parental rights of the appellant Leo Thompson and his wife Donna and place the child…
