Spring, J. :

Plaintiffs, as executors, of the last will and testament of Alvin Richmond, deceased, were creditors to the extent of over $15,000 ■of Seth M. Richmond, who died on the 26th day of April, 1895; ' Seth M. Richmond left a last will and testament which was duly admitted to probate.in May, 1895, and letters testamentary thereon were issued to the executor Charles King by the surrogate of the county of Herkimer May sixth of that year.
