This cause came on for consideration of the Motion for Summary Judgment (Doc. # 13) filed by Plaintiff, Frederick L. Ran-sier, Trustee, (“Trustee” or “Plaintiff’), the Response (Doc. # 15) filed by Countrywide Home Loans, Inc., (“Countrywide” or “Defendant”), and Trustee’s Reply (Doc. # 16) filed in the above captioned adversary proceeding. The Court having considered the record and the arguments of the parties, makes the following findings and conclusions.
