BELL, Chief Justice.
This is an appeal from the judgment of the District Court denying, on appeal to that court from the Probate Court, the probate of alleged will of Leon F. Huckaby dated October 18, 1953. A jury had found in answer to Special Issue No. 6 that the will had been revoked. Appellants are the surviving brother and mother of the testator who were the proponents of the will. Appellee is the son of the testator and his ■only heir.
