Appeal from an order of the Supreme Court (Kane, J.), entered July 21, 2000 in Sullivan County, which, inter alia, denied a cross motion by defendant Workmen’s Circle/Arbetter Ring Branch 281 for summary judgment dismissing the complaint against it.
Between 1974 and 1992, plaintiffs interred five family members in the family burial plot in a cemetery owned and operated by defendant Workmen’s Circle/Arbetter Ring Branch 281 (hereinafter defendant) in the Town of Thompson, Sullivan County.
