The appellee, Faye Robertson Burgess, filed a complaint in the Circuit Court of Jefferson County, Birmingham Division, seeking a divorce from the appellant, Arthur E. Burgess, Jr., on the grounds of incompatibility of temperament, irretrievable breakdown of the marriage, and physical cruelty with danger or apprehension of danger to life or health. The appellant answered by admitting the marriage and the existence of the family but denying the grounds for divorce.
