THIS MATTER comes before the Court on the Defendant’s Motion to Dismiss, filed May 14, 2010 (Doc. 5). The primary issue is whether Plaintiff Charity Gose’s claims for false arrest and false imprisonment under the New Mexico Tort Claims Act, NMSA §§ 41-4-1 through 41-4-27 (“NMTCA”), are barred as untimely.
