The action is .at law, brought by Naomi Christensen, a minor, by her mother and next friend, Minnie Christensen, against Bernie Boucher, to recover damages because of his forcible defilement of her, resulting in the birth of a child to her. She alleged that said defilement was forcible and against her will and despite any resistance she could make. She- claimed to have sustained actual damages in the sum of $25,000.
