Cornelian P. Bussell, the plaintiff in error, exhibited in the court below his bill in chancery against the defendants in error, as lieirs-at-law of one Francis Peyton, deceased, to compel the conveyance from them to him of the west half of the southwest quarter of section twenty-nine, township thirty-seven, range fourteen, in Cook county, Illinois. The bill is based upon an instrument in the nature of a declaration of trust, bearing date June 10, 1837, executed by said Francis Peyton to Cornelia Bussell, the complainant’s mother.
