OPINION DENYING APPEAL

LEWIS, Judge.

T 1 Greg Costello Sayerwinnie was charged in the District Court of Oklahoma County, Case No. CF-2002-7085.1 At a Jackson v. Denno2 hearing, the Honorable Virgil Black, District Judge, ruled that Sayerwinnie's confession must be suppressed. The State announced its intention to appeal pursuant to 22 0.8.8upp.2002, § 1053(5). The trial court stayed the district court proceedings. Section 1058 provides, in part, that the State may appeal,
