MEMORANDUM AND ORDER

NEALON, District Judge.

Plaintiff, Jerome Boykin (“Boykin”), an inmate currently incarcerated in the State Correctional Institution, Somerset, Pennsylvania (“SCI-Somerset”), initially filed the above captioned civil rights action pursuant to 42 U.S.C. § 1983 in the United States District Court for the Eastern District of Pennsylvania. The action was subsequently transferred pursuant to 28 U.S.C. § 1406(a), to this court.
