MEMORANDUM OPINION AND ORDER

MB Financial Bank (“the Bank”) has sued Roy Walker to recover $3.7 million for breach of a subordination agreement and a collateral assignment and for tortious interference with the Bank’s $19 million credit agreement with WES Construction Company (“WES”). Mr. Walker was the president and majority shareholder of WES. (Complaint, ¶¶ 1-9).
