The defendants were jointly charged, tried and convicted of setting fire to the contents of a store building in Modesto, contrary to the provisions of section 448a of the Penal Code. The defendant, Angelopoulos, also known as Angelo, was also convicted of a second count of the same information wherein it was charged that the defendants attempted to burn the merchandise and equipment of the grocery store with intent to defraud the insurance carrier thereof, contrary to section 450a of the same code.
