¶1 Lita Pepion filed a complaint with the Department of Labor and Industry’s (DOLI or the Department) Human Rights Bureau challenging her termination from employment with the Indian Health Board of Billings, Inc. (IHBB). Twelve months after Pepion’s complaint had been filed, IHBB sought dismissal of the complaint and a “Right to Sue” letter on the ground that DOLI had failed to hold a timely contested case hearing.
