In February, 1925, Charles Bender, husband of appellant, was the owner of the property located at 725 South Preston street, Louisville, Ky. The property was under mortgage, and the mortgagee foreclosed his lien and the property was sold pursuant to judgment of the court and bought by Ben Kaelin, one of the appellants herein, for $6,500,. and Kaelin received deed- therefor in February, 1925.
