OPINION AND ORDER

SMITH, Senior Judge.

INTRODUCTION

This case is a hybrid of the Winstar cases that this court has examined over the last ten years. However, because the court determined liability, if found, might rest on a different statutory foundation, this case has been separated from the Winstar case management plan. Because of its hybrid nature the court will address novel issues that are *260unique to these plaintiffs. In this opinion, the court addresses the Defendant’s Motion for Judgment on the Pleadings and the issues argued by the parties in a six month trial.
