Paul E. Cherry (“Cherry” or “plaintiff’), an African-American male, is a retired police officer who worked at Elizabeth City State University (“ECSU” or “defendant”). Cherry (who proceeds pro se) claims that ECSU did not promote him to captain in April 2011 due to his race and later retaliated against him for complaining about race discrimination, thereby violating Title VII of the Civil Rights Act of 1964.
