Appellant filed suit against appellees alleging assault and battery and appellees counterclaimed, also alleging assault and battery and praying for the recovery of expenses, costs and attorney fees. Appellees amended their counterclaim to add a claim for damages, expenses and attorney fees pursuant to Yost v. Torok, 256 Ga. 92 (344 SE2d 414) (1986) and OCGA § 9-15-14. After the close of the evidence, in a jury trial, appellees withdrew their “Yost” and § 9-15-14 claim.
