After a juiy trial, the defendant, David A. Gibbs, was convicted of two counts of murder in violation of General Statutes § 53a.-54a.,1 and one *580count of capital felony in violation of General Statutes § 53a-54b (8).2 The trial court, Spada, <■/., rendered judgment in accordance with the jury’s verdict on the capital felony count only,3 and, after the state withdrew its request for the death penalty, sentenced the defendant to life in prison without the possibility of release.
