—In an action to recover damages for medical malpractice and lack of informed consent, the defendant Bernard Rimler appeals from a judgment of the Supreme Court, Kings County (Garry, J.), entered September 2, 1997, which, upon a jury verdict finding him 40% at fault for the plaintiffs injuries and the defendant Joel J.
