OPINION

COOLAHAN, District Judge:

This patent infringement suit involves a variation of the familiar “backyard”, above-ground swimming pool. Plaintiffs charge that similar pools manufactured and sold by defendant are an infringement of Claims 11, 12 and 15 of plaintiffs’ United States Letters Patent No. 3,317,926 (hereinafter “’926”). The application was filed on October 26, 1964, and the patent issued on May 9, 1967 to Raymond L. Hall (hereinafter “Hall”) the inventor-owner and a plaintiff herein. Said patent is exclusively licensed to Quaker City Industries, Inc. (hereinafter “Quaker City”)…
