This matter is before the en banc Court on the Appellant’s Motion for an Entry of Judgment. In Obergefell v. Hodges, — U.S. —, 135 S.Ct. 2584, 192 L.Ed.2d 609 (June 26, 2015), the United States Supreme Court recently held that (1) states are required to license a marriage between two people of the same sex, and (2) states are required to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out of state.
