OPINION AND ORDER

GWIN, District Judge.

On May 5, 1997, Defendants City of War-rensville Heights, John L. Kalavsky and Raymond Grabow filed motions to dismiss the amended complaint in case 97-CV-162 [Docs. 15, 16, 17]. On October 30, 1997, and November 7, 1997, these same defendants filed motions to dismiss the complaint in case 97-CV-2312 [Docs. 7, 8, 9]. 1

In making these motions to dismiss, defendants argue that the plaintiffs in both actions have failed to state a claim upon which relief can be granted, Fed.R.Civ.P. 12(b)(6). In these cases, plaintiffs -say defendants disseminated private…
