COFFEY, Circuit Judge.
Ronald J. McAllister (“McAllister”) was indicted on one count of manufacturing marijuana and one count of possessing marijuana with the intent to distribute in violation of 21 U.S.C. § 841(a)(1). The defendant moved to suppress the marijuana seized pursuant to a search warrant, and sought an evidentiary hearing challenging the warrant affidavit under Franks v. Delaware, 438 U.S. 154, 98 S.Ct. 2674, 57 L.Ed.2d 667 (1978). The magistrate judge denied the motion to suppress and the motion for a Franks hearing in an order dated December 16, 1992.
