— This is a subrogation action for damages arising out of an accident wherein appellees’ truck *230ran into a building, The First National Bank of Dyer, Indiana. The First National Bank of Dyer collected from the appellant under an insurance policy and the appellant acquired subrogation rights.

Suit was originally brought in the name of Sun Insurance Company, Inc. and summons issued thereon, September 29, 1944.
