The appellant presents two propositions for our consideration: (1) that the plaintiff has not made out a case of negligence; (2) that if negligence existed it was not the default of the defendant. The plaintiffs bought tickets from the defendant at its office in Philadelphia, on Sunday, May 6, 1906, for an excursion trip to Valley Falls and return.
