The opinion of the court was delivered by

John Snyder, in his lifetime, on the 1st ■of March, 1884, made a lease, under seal, of premises in the •city of Newark, known as No. 226 Washington street, for the term of five years from April 1st, 1884.

The said lease contained the following covenants:
