This is the second time this case has been reported to this Division. This present appeal is from the new trial held in accordance with our order in our prior decision which appears in 21 LEGALITE 467, rendered on December 30, 1969 in which we decided that the trial justice acted inconsistently in the granting of the plaintiff’s and defendant’s request for rulings.
