PHILLIPS, Chief Justice.

This suit was brought by appellee, a professional engineer, against the City of Austin for engineering services performed in connection with what was termed at trial as “the West 26th Street Project.” Appellee pleaded two alternative causes of action against appellant City, one for reformation of the contract between the parties, the other, for rescission of the contract. In response to a jury verdict, which found, among other things, mutual mistakes on the part of both parties, judgment was entered for appellee rescinding the *581contract and granting appellee judgment…
