HARPER, Judge.

Appellant was indicted, charged with murder, and when tried he was convicted of manslaughter.

The application for a continuance not being copied in the record, nor embraced in the bill of exceptions, we can not determine whether or not the court erred in overruling the motion.

The evidence in this case shows that appellant and deceased were hauling gravel for Frank Williams, each of them having a separate wagon. The morning of the difficulty they had some words, but they parted without coming to blows; that afternoon they both drove to the gravel pit to load their wagons, when…
