VAN GRAAFEILAND, Circuit Judge:
This is an appeal by the Government from an order of the United States District Court for the Western District of New York (Elfvin, J.) suppressing certain evidence and oral admissions which followed appellee’s warrantless arrest. Although the district court found that the arrest was based on probable cause, thus satisfying the requirement of United States v. Watson, 423 U.S. 411, 96 S.Ct. 820, 46 L.Ed.2d 598 (1976), it held the arrest to be illegal under Payton v.
