Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered February 22, 1999, upon a verdict convicting defendant of the crimes of driving while intoxicated and aggravated unlicensed operation of a motor vehicle in the first degree.

Acting in response to a report received from a resident of the neighborhood, the police discovered defendant unconscious behind the wheel of his automobile. Although the engine was running at a steady, high rate of speed, the car remained in its position at the curb of Olive Street in the Village of Johnson City, Broome County.…
