This case is before us by way of an appeal under the provisions of Rule 78 of the Maine Rules of Civil Procedure.

The cause is an action to recover for damages to personal property, arising out of an automobile accident. Both parties were proceeding in a northerly direction on a public highway leading from Kennebunk to Biddeford, in the County of York. The defendant was operating a truck loaded with junk.
