This is an appeal from a judgment entered in April, 1939, in the District Court. of the United States for the Western District of North Carolina at Charlotte, in an action in which the appellant, Kate J. Davis, was the plaintiff and the appellee, The Fidelity Mutual Life Insurance Company 'of Philadelphia,' Pennsylvania, here referred to as the defendant, was the defendant.
