This is a certified question from the Court of Civil Appeals of the Third Supreme Judicial District. The statement and question are as follows:

“This case originated in a Justice of the Peace Court in a suit brought by E. J. Ellis against H. A. Lawrence, Gordon Gaither and H. H. Lewellyn. The judgment was rendered for the plaintiff against all the defendants, and the latter gave notice of appeal to the County Court. In ordei; to perfect that appeal the defendants, together with three sureties, executed, and the justice of the peace approved, an appeal bond which reads as follows;
