The defendant Attoyac Properties, Inc. owed the plaintiff a commission for obtaining a loan of $2,200,000 for Attoyac from the defendant Diversified Mortgage Investors. By a bill brought on June 15,1972, pursuant to G. L. c. 214, § 3(7), as in effect prior to St. 1973, c. 1114, § 62, the plaintiff sought to reach and apply the undisbursed $250,000 portion of that loan in payment of the commission.
