This was an application for a peremptory writ of mandamus, to compel the State treasurer to countersign and register an auditor’s-warrant. The journals of the two houses of the general assembly, not having been returned and filed with the secretary of State, and still being in the hands of the clerks of the two houses, the auditor acted alone upon the bill signed by the president of the senate, the speaker of the house, and approved by the governor, which was regularly deposited in the office of the secretary of State as a valid and binding law.
